Terms of services determine the legal framework that governs the relationship between the web page under the domain (www.fanzapp.io) and the pertaining applications in Google Play and App Store which are owned fully by teamup est. for information technology under commercial record (1010797258). fanZ platform stands for both the applications and web page of fanZ. Anyone who uses fanZ platform or benefits from it will be referred to as “User”. fanZ platform services are exclusively restricted to those who agree on fanZ platform Terms of Services where each user is obligated to agree on terms of services. Using fanZ platform - or any of fanZ products or other services related to those terms, which are all referred to as “services”,- means that you agree on all terms.
First Term:
Definitions
In order to achieve full compliance with all terms, this term is meant to clarify meanings of several words whose meanings need to be clearly identified. Hence, the definitions mentioned here are considered effective unless context states otherwise.
● Services stand for all fanZ platform services provided to all users.
● Terms of Services stand for rules, laws, policies ,procedure and terms related to platform services and using them, which can be changed, adjusted, or canceled by fanZ platform and/or those who manage the platform without a predetermined permission from any party, which are shared electronically on the platform.
● Confidential Data stands for any data related to the platform business, affairs, current services, future services, trade secrets, manpower, users or any other data that are dealt with in the platform and is classified as confidential or owned by the platform or can be viewed as confidential data or as valuable to the platform competitors. Confidential data does not include data that is publicly available or data known to the public, excluding data resulted from user violating confidentiality. Confidential data does not include personal data or/and public data for user(s) who voluntarily disclose them.
● Personal data stands for data that include- but not limited to-: username and/or contact information, and/or national identify and/or Iqama number and /or freelancing permit number and/or phone number and/or email and any date asked for by the platform in order to determine user identity.
● customer stands for everyone - male or female- including new customers, registered customers or visitors who benefit from the platform services through signing up and providing their personal data voluntarily to get access and benefit from offers in the platform.
● User stands for any person - regular or legal- who signed up in the platform including but not limited to: customer and/or and/or service provider and/or team owner and/or facility owner and/or visitor and/or beneficiary through complying with the terms and conditions of the platform with the purpose of getting access to platform services and benefiting from them.
● Platform -wherever mentioned in the terms of service- stands for fanZ web page and/or fanZ applications.
● Expectation refers to the process in which a user expects a score of a football game through fanZ platform.
● Prizes refer to rewards that fanZ platform gives to users upon reaching specific levels with specific conditions. All prizes are not a liability on fanZ platform. Prizes are available in limited quantities and are only given upon availability in fanZ store. Prizes are not usually provided in cash. In case fanZ platform allowed the cash option for some prizes, it is only available for users in Saudi Arabia. fanZ platform have full right to not give won prizes if they are not available in the store and users do not have the right to demand it as they are not a liability on fanZ platform. In case, prizes were not received by users during claiming awards for any reason, fanZ platform is not held responsible for the prize.
● Level refers to users ranking that is determined according to his/her activity in the platform. fanZ platform is fully authorized to change or adjust how levels are determined. In addition, fanZ platform is fully authorized to determine the method of calculating and determining levels in the way fanZ platform finds to be suitable.
● Store stands for the online store in fanZ apps in which users claim their prizes.
Second Term: Who can use fanZ platform services:
Those who are below 13 years are not allowed to sign up and use the services.
Using fanZ platform implies:
● Your eligibility to enter into a binding contract with fanZ platform. In case you receive fanZ services on behalf of another party or organization, you recognize that you are authorized and allowed to agree on these terms on behalf of the party or organization that you represent.
● You are a person who is allowed to receive the services as per the laws of the Kingdom of Saudi Arabia.
● You have never been accused of sexual abuse.
● You will comply with all of these terms and the laws of the Kingdom of Saudi Arabia.
Third Term: Notes on signing up on fanZ platform:
During Signing up in fanZ platform, user has to provide updated correct data
according to the latest official documents. User agrees on giving fanZ platform the right to view user data and personal information, verify them and use them. In addition, user waives any legal consequences or impacts that could result from revealing collected data to external parties. fanZ platform is fully authorized to stop services provided to a user or cancel his/her account -completely or partially- in case the platform failed to determine/verify user identity and data. fanZ platform has the full right to stop any additional accounts to the same user. User acknowledges that his/her use of fanZ platform will be for legitimate purposes only and that he/she will not use the platform to do an act that leads to a crime or violation as per any effective law in the Kingdom of Saudi Arabia. fanZ platform has the full right to deactivate or delete any account - with or without notifying the user- if any of the terms of services were violated. fanZ platform is fully authorized to monitor any materials or content uploaded or displayed by users and in case any materials or content were found to violate the platform or others rights, the platform has the ultimate right to delete, remove or edit any of these materials without explaining any reasons. User has to keep his/her information confidential including but not limited to: username, password, email and phone number where user is considered responsible for use of his/her personal account. In case of an actual or suspected use of account, user has to immediately notify the platform. In case an account was hacked or used illegitimately, fanZ platform - after verifying the case- will cooperate -with no obligation- with users to retrieve their accounts and the platform will not be responsible for any impacts that could result from this illegitimate use of account.
fourth Term:
fanZ platform is not responsible for any loss of profits, or any loss of any kind, as a result of the information or services that you provide, or as a result of information that user has added. In addition, the platform is not responsible for any loss, amendment, or damage to user data stored on the platform, which results in an unauthorized person obtaining the right to access user data stored with the platform. fanZ platform provides secure access to the platform, including services provided through it, but fanZ platform does not guarantee the ability to enter continuously and completely freely due to factors beyond the control of the platform. Accordingly, fanZ platform does not bear any financial consequences or losses or losses of any kind as a result of a breakdown, interruption or defect in the services provided through the platform, bearing in mind that the platform reserves the right to prosecute the hacker as well as those who try to penetrate the platform. Under all circumstances and conditions, fanZ platform is absolutely not responsible for any of the following matters: Any expenses or losses that may occur due to the use of the platform or the delay in the response of the platform for any reason whatsoever or the system failure or the occurrence of any error in the system or exposure of computers or mobile phones to viruses or abuse of customer reputation. Furthermore, user is not permitted to copy, distribute, modify, sell or rent any of fanZ services. User may not extract the program commands for fanZ platform except in the case of obtaining official written permission from fanZ platform authorizing him/her to do so.
Fifth Term:
User must comply with all laws, conditions and regulations of fanZ platform while using the platform or performing any of the activities related to it. In the event that a dispute or conflict arises about the implementation, interpretation, cancellation, annulment, validity or nullity of any of the current terms and conditions - which fanZ platform has the right to amend at any time - it is decided according to the arbitration system in the Kingdom of Saudi Arabia, provided that the location of arbitration is in the city of Riyadh. The official language used in arbitration is Arabic.
Sixth Term:
The rights granted by users to fanZ platform:
fanZ platform has the right to use the user-generated content, upload it, publish it, send it, receive it and store it based on the use permission that is granted to fanZ by users of the platform. fanZ has the right to access, review, check and delete users’ content at any time for any reason, whether the reason is related to developing and improving services or if the content violates the terms of services.
Disclaimer: User remains solely responsible for the content that he/she creates, uploads, publishes, sends or stores it through the services of the platform. For public content - which is set so that everyone can see it - which is produced by user, user grants fanZ platform and its affiliates a global, royalty-free, sub-transferable and assignable license to host, store, use, display, reproduce, modify, adapt, edit, publish and distribute that content. The license granted to fanZ platform is within the scope of operating, developing, providing, promoting and improving services, research and developing new services.
For public content, you grant fanZ and our business partners the same exact rights you grant to the non-public content mentioned in the previous paragraph, in addition to a permanent license to create derivative works from them, promote, display, broadcast, publish by newspapers, publish to the public, and display public content in any form and in any and all media or means of distribution (known today or later). To the extent necessary, when you appear in public content that you create, upload, post, or send, you also grant fanZ platform, its affiliates, and our business partners the right and an unlimited, worldwide, and permanent license to use your name, image and voice, including that related to commercial content and subject to sponsorship. This means several things including that you do not have the right to obtain any compensation from fanZ platform or any of its affiliates, or our business partners if your name, image or voice is traded through the services, whether on fanZ platform or on one of our trading partners' platforms. When you use fanZ platform services, you agree that we, our partners and our affiliates will place advertisements on the services. Additionally, advertisements may sometimes appear near your content. fanZ reserves the right to review or remove all content on the platform services. However, fanZ platform does not necessarily review all content. Accordingly, fanZ platform does not bear any responsibility for any content provided by others through the platform services. Furthermore, fanZ platform does not guarantee that all the content provided through its services is in compliance with the platform terms and instructions.
fanZ platform always calls on users to provide it with opinions and suggestions. But in the event that you submit suggestions or opinions, fanZ platform has the right to benefit from them without providing you with compensation, and without any limitation or obligation towards you. There is a lot of content available on fanZ. This content is produced by users as well as third parties. This content remains the responsibility of the person, organization, or user who provided it only, whether this content is publicly published or sent privately.
Seventh Term:
User Privacy:
User privacy is important to fanZ. You can familiarize yourself with fanZ platform policy by reviewing the platform privacy policy. We would like to note that once you use the services of fanZ platform, you agree to the privacy policy of the platform with all its terms and conditions.
Eighth Term: Amendment to data or services
User acknowledges that fanZ platform has the right to amend, update or change the platform services or the items stipulated in the terms of service from time to time. Therefore, fanZ platform recommends that user reviews the terms of service periodically and regularly. User agrees that his/her continued use of the platform after updating or changing the terms of service constitutes his/her acceptance of the updated terms of service.
Ninth Term:
General Rules
Platform Ownership: fanZ platform and its owners own the full right and absolute and unsuspended freedom on all terms and conditions. fanZ platform is also entitled to transfer its services, merge, and/or sell assets, mortgage and/or other actions related to the right of ownership, whether in whole or in part, to third parties, whether with or without compensation, without the need for any written approval or verbally from others, or the need to conclude any legal action to exercise this right.
Divisibility: In the event that any term of the Terms of Service is deemed null, illegal, or unenforceable, either in whole or in part, the validity, legality and application of the rest of the current terms will not be affected in any way, and accordingly, the rest of the terms will remain in effect and enforceable between the platform and user. The platform must strive to amend the non-valid term to the extent necessary, to make it valid and enforceable in the confrontation of the parties, provided that this new amended term has an effect similar to the extent possible to the previous illegal, invalid or unenforceable term or part of it, in light of the content of this agreement and its purpose without the need to take any legal or regulatory action to activate this amendment.
Waiver: None of the terms herein is considered a waived term, and any breach is not excused, unless this assignment or approval was provided by the platform or approved in writing and signed by it. In addition, any waiver by fanZ platform on a user breach of any of the terms or conditions or any part of them, whether explicit or implicit, does not constitute a waiver of any other breaches of the terms herein.
Correspondence: Correspondence shall be on the platform addresses shown in the (Contact Us) page, and the correspondence shall be on user addresses, on his/her address indicated in his/her personal information upon creation of the account, and any other correspondence other this shall not be taken into account. The correspondence shall be effective on the correspondence recorded with an acknowledgment of receipt, whether paper or electronic correspondence.
Effective date of terms and conditions: These terms and conditions are effective from the date user presses on option ('I Agree').
The entire agreement: the current terms and conditions constitute the entire agreement between user and the platform regarding this issue, and all previous offers, agreements or promises, whether verbal or written, shall be canceled and shall not be considered in the confrontation of the parties.
Cancellation of the account: The platform has the absolute right to cancel user account at any time without the need to express any reasons and/or prior notice and/or compensation for this cancellation and/or taking any legal or regulatory measures in this regard, and hence user acknowledges the right of the platform to take this action at any time.
Language: When there is a difference of interpretation or concept between Arabic and English from these terms and conditions, the arbitration and adjudication shall be for the rules and terms of the Arabic language and not the rules and terms of the English language.
